It Should Take More Than 10 Minutes to Evict Someone

Two-minute trials in crowded courtrooms. Ten-minute evictions. Incalculable suffering. Before Covid, this was — and had long been — the reality in many eviction courts. But during the pandemic, an influx of federal funds has helped courts begin dozens of eviction prevention and diversion programs for landlords and tenants. Often coupled with other reforms, like remote court hearings and community outreach efforts, these programs make eviction court easier to navigate and more accessible.

JALA ensures child is no longer in danger of overheating

“Josie,” who lives in an apartment with her 4-year-old son, sought help from JALA after experiencing repeated problems with her apartment’s air conditioning unit. Josie’s son has multiple disabilities and is at risk if he becomes overheated. During the day in the summer, the temperature in her apartment would go above 85 degrees, forcing her and her son to leave until after 8 p.m. each day. Maintenance of the air conditioning unit is the responsibility of the property management, but the manager made only excuses and not the necessary repairs.

JALA helps veteran with service-related disabilities remain housed

“Antonio” is a veteran with service-related disabilities who lives in low-income housing in Jacksonville and receives a monthly voucher payment from the Jacksonville Housing Authority that enables him to stay stably housed. In 2018 JALA attorney Adam Thoresen helped Antonio obtain a reasonable accommodation request to increase his housing voucher payment to enable him to afford his housing.

JALA’s Fair Housing Unit helps immunocompromised client break lease on rat-infested home

“Lashawn,” who participates in the Housing Choice Voucher Program, came to JALA for help when her rental home became uninhabitable and her property manager refused to allow her to break her lease so that she could relocate. The conditions in the home, which included holes in the floors that allowed rats to enter, were adversely affecting her health, which was already compromised by kidney disease requiring dialysis.

JALA protects senior and an adult son with disabilities from eviction

“Louise,” 80, lives with her son in an apartment partially subsidized with a Housing Choice Voucher. She and her son, who has a disability, both receive Social Security benefits, which they depend on to pay the rent. Because the rent is due by the 15th of each month and the Social Security checks do not arrive until the fourth Thursday of the month, Louise has struggled to pay the rent on time.

Jacksonville attorney: Volunteer lawyers needed nationwide to help COVID eviction tsunami

Jacksonville attorney Mike Freed has left his mark locally cultivating an annual series of marathons raising money for Jacksonville Area Legal Aid. Now he’s asking lawyers around the country to donate their time to help to help prevent a deluge of evictions rooted in the pandemic’s effect on jobs and incomes. “Sometimes you have to give up your time without compensation for the greater good,” said Freed, who is president of the National Conference of Bar Presidents, an organization involving Bar associations in 53 states and U.S. territories.

Jacksonville evictions displace many as renters, landlords face problems during pandemic

As COVID-19 cases have surged across Northeast Florida, thousands of people have continued being evicted from local homes despite federal rules written to prevent that during the pandemic. Duval County judges issued 1,991 orders for police to evict tenants during the first seven months of this year, when landlords filed 4,716 lawsuits to take back rental homes, the Duval County clerk of courts office reported.

Pro bono attorney helps widow and mother of three escape a nightmare home

Christina McEuen was still adjusting to life as a widowed mother of three when she signed a lease on a small home in the Mandarin neighborhood of Jacksonville in 2016. Almost immediately after moving in, McEuen found the house had leaks everywhere, including the roof, pipes, and water heater. When an outlet caught fire, she discovered the fire extinguisher didn’t work. The handyman sent to correct the problems essentially applied useless Band-Aids to gaping wounds. “This house was a nightmare,” said McEuen, who had been a server at St. Mary’s Seafood and More until she gave birth to a baby with a compromised immune system and other special needs, including severe autism. Early in her pregnancy, her husband had died in a trucking accident, so she was alone in caring for her little Mikey and his older brothers, William and Jeffrey.
